Effective Date: January 1, 2024
Please read these Warranty Terms and Conditions ("Terms") carefully. By checking the acceptance box and submitting your warranty registration, you ("Buyer") acknowledge that you have read, understood, and agree to be bound by these Terms.
1. Warranty Coverage
Southwestern Equine warrants the registered product ("Product") against defects in materials and workmanship under normal use for a period of one (1) year from the date of warranty registration. This warranty extends only to the original Buyer and is non-transferable.
2. Warranty Claim Procedure
To initiate a warranty claim, Buyer must contact Southwestern Equine and provide proof of purchase, warranty registration confirmation, and a detailed description of the alleged defect. Southwestern Equine requires photographic and/or video documentation of the damage or defect to evaluate all warranty claims.
3. Shipping Responsibilities
(a) Buyer shall submit photographic and/or video documentation of the alleged defect as requested by Southwestern Equine.
(b) If Southwestern Equine, at its sole discretion, is satisfied that the submitted photographs or video evidence demonstrates a failure of materials or workmanship covered under this warranty, Southwestern Equine shall ship a replacement saddle pad to Buyer at no additional cost to Buyer.
(c) If the defect or failure cannot be adequately determined through photographic or video documentation, Southwestern Equine reserves the right to request that Buyer ship the Product to Southwestern Equine for inspection. In such cases, Buyer shall be responsible for all shipping costs and fees associated with sending the Product to Southwestern Equine. Upon confirmation of a valid warranty claim, Southwestern Equine shall ship the repaired or replacement Product to Buyer at no additional cost.
4. Warranty Remedies
At its sole discretion, Southwestern Equine will repair or replace any Product determined to be defective under the terms of this warranty. This warranty provides for repair or replacement only. No cash refunds shall be issued, and no right to monetary compensation is expressed or implied under this warranty.
5. Exclusions and Limitations
This warranty does NOT cover:
(a) Normal wear and tear resulting from ordinary use;
(b) Discoloration, fading, or cosmetic changes that do not affect the functional performance of the Product;
(c) Damage resulting from misuse, abuse, neglect, accident, or improper care;
(d) Damage resulting from alterations, modifications, or repairs performed by anyone other than Southwestern Equine;
(e) Damage resulting from failure to follow product care instructions;
(f) Products purchased from unauthorized resellers or secondary markets.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Southwestern Equine's liability under this warranty shall be limited solely to the repair or replacement of the defective Product. In no event shall Southwestern Equine be liable for any incidental, consequential, special, or punitive damages.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas.
